These Terms of Service ("Terms") govern your access to and use of the NAKAMODI website, Discord community, courses, mentorship and all related content and services (together, the "Service"), operated by NAKAMODI ("Nakamodi", "we", "us" or "our"). Please read them carefully.

1. Educational purpose only — not financial advice

Nakamodi provides trading education and mentorship only. All content, lessons, community discussion, examples, mentorship and materials are provided strictly for general educational and informational purposes. Nothing in the Service constitutes, or should be relied upon as, financial, investment, trading, legal, tax or other professional advice, a solicitation, or a recommendation to buy, sell or hold any financial instrument. We are not a licensed broker, financial adviser or investment firm. You should seek advice from an appropriately qualified, independent and licensed professional before making any financial decision.

2. Risk Disclaimer

Trading the financial markets involves a substantial risk of loss and is not suitable for everyone. You may lose some or all of the capital you commit, and you should never trade with funds you cannot afford to lose. Results are not guaranteed. Past performance, examples, or any content shared through the Service are not indicative of and do not guarantee any future outcome. Any decisions you make are made entirely at your own risk and are your sole responsibility.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements.

4. Memberships, purchases and payments

Access to certain parts of the Service, including mentorship, is provided through paid membership. Payments and checkout are handled by third-party providers (such as Whop), and any trial, billing, renewal, cancellation and refund terms are as presented at the point of purchase and/or by that provider. You are responsible for managing your subscription in accordance with those terms.

5. Third-party services

The Service relies on and links to third-party platforms, including Discord, Whop, TikTok and our hosting provider. We are not responsible for the availability, content, policies or practices of any third-party service, and your use of them is governed by their own terms and privacy policies.

6. Acceptable use

You agree not to: share, resell, redistribute or reproduce our content or materials without permission; disrupt or misuse the Service or community; harass other members; or use the Service for any unlawful purpose. We may suspend or terminate your access at any time, without notice, for any breach of these Terms.

7. Intellectual property

All content, materials, branding, strategies and resources provided through the Service are the property of Nakamodi or its licensors and are protected by applicable intellectual property laws. You are granted a limited, personal, non-transferable licence to use them for your own educational purposes only.

8. No warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content will produce any particular result.

9. Limitation of liability — zero liability

To the maximum extent permitted by law, Nakamodi, its founder, team, affiliates, partners and contributors assume zero liability and shall not be liable for anything arising out of or connected with your use of the Service. This includes, without limitation, any trading losses, financial losses, loss of profits, loss of data, loss of opportunity, or any direct, indirect, incidental, special, consequential, punitive or exemplary damages, whether based on contract, tort, negligence, strict liability or any other legal theory, and whether or not we have been advised of the possibility of such damages.

You acknowledge and agree that you use the Service entirely at your own risk, that you are solely and absolutely responsible for all of your own decisions, trades, outcomes and losses, and that you waive, release and hold harmless Nakamodi from any and all claims, demands, damages and liabilities of every kind.

10. Indemnification

You agree to indemnify, defend and hold harmless Nakamodi and its founder, team and affiliates from and against any claims, liabilities, damages, losses and expenses (including legal fees) arising out of or in any way connected with your use of the Service, your trading activity, or your breach of these Terms.

11. Changes to the Service and Terms

We may modify, suspend or discontinue any part of the Service, and we may update these Terms at any time. Changes take effect when posted on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales, to the extent permitted by applicable law.
